These Terms and Conditions govern access to, browsing of, and purchases made through the Kaikana Musicals website. By using this website or placing an order, you agree to these terms.
1. About Kaikana Musicals
Kaikana Musicals creates and distributes original musicals for use by schools, academies, theatre schools, camps, cultural entities, companies, organizations, and other authorized groups.
For questions about purchases, licenses, or use of materials, contact us at license@kaikanamusicals.com.
2. Who may purchase
Kaikana Musicals products are intended for institutions, organizations, educational centers, academies, theatre companies, cultural entities, camps, and authorized groups.
Purchases must be made on behalf of an authorized institution or organization. The products are not intended to be purchased as a private individual for individual private use.
3. Digital products
All products sold by Kaikana Musicals are digital. No physical materials are shipped.
Depending on the musical purchased, the package may include the script, songs, backing tracks, sound effects, scores, production resources, suggested choreographies, graphic materials, or other resources available for that title.
The exact contents of each package are shown on the corresponding product page and may vary from one musical to another.
4. Access to materials, account, and downloads
After purchase, the order will be associated with the email used during checkout.
The customer will be able to access materials, licenses, and downloads from their Kaikana Musicals account. If the customer does not yet have an account, they will be able to activate or create one using the email used at checkout.
The customer is responsible for entering accurate contact, email, institution, and license information during checkout.
5. Standard educational license
The purchase of a musical includes a standard annual educational license unless another license option is selected during checkout.
This license is designed for schools, accredited educational centers, academies, school theatre programs, and cultural camps. It allows the authorized organization to perform the purchased musical within the educational context for one year from the license start date selected during checkout.
During that one-year period, the authorized organization may hold as many educational performances of the purchased musical as it wishes, with no limit on the number of performances and at no additional cost, provided they remain within the relevant educational or institutional context.
6. Ticket sales in educational settings
Schools and educational organizations may sell tickets when the purpose is to cover production costs, support the educational activity, or raise funds for the school or organization.
If the production takes place outside the standard educational context or has a professional, commercial, or independent cultural nature, the professional / cultural license must be selected.
7. Professional / cultural license
The professional / cultural license is designed for theatre companies, cultural entities, community theatres, private academies, organizations, commercial productions, or productions outside the standard educational context.
This license is an add-on to the digital musical materials price. The materials are purchased normally, and the professional / cultural license adds $100 per authorized performance in the English checkout.
For example, if a musical costs $159 and 3 professional performances are selected, the total will be $159 + $300 = $459.
The professional / cultural license allows performances outside the standard educational context and may include ticket sales, for the number of performances authorized during checkout.
8. License renewals and additional performances
If an organization has already purchased a musical, it may renew the annual educational performance license without buying the full musical materials package again. Educational annual renewals cost $90 and are processed from the customer account.
To renew a license, the customer must log in with the same email address used during the original checkout and select the relevant license from My Account. The renewal is added to the cart and paid through Stripe like a normal order. After successful payment, Kaikana Musicals automatically creates a new order, invoice and license record, and the renewed license becomes available in the customer account.
Professional / cultural licenses may be extended with additional authorized performances at $100 per additional performance. These extensions must be linked to the original license and may only be purchased by the organization or account holder associated with that original purchase.
Kaikana Musicals may block, reject or manually review any renewal or extension attempt if the original purchase, account, email, institution, musical, license type or usage context cannot be verified.
9. Languages, prices, and currency
Spanish and English versions of a musical may be treated as separate products and may have different prices or currencies.
On the Spanish website, prices are primarily shown in euros. On the English website, prices may be shown in US dollars. Stripe or other payment providers may offer conversion or local-currency payment options depending on the customer’s location.
The customer must review the final price shown at checkout before confirming payment.
10. Recording the performance
The license includes permission to record the performance under Kaikana Musicals’ conditions.
Sharing excerpts or recordings may be allowed when Kaikana Musicals is credited appropriately. Commercial sale or unauthorized monetization of recordings is not allowed unless specifically authorized in writing.
11. Internal printing and copies
The license allows internal printing or copying of materials for the cast, creative team, rehearsals, and production use within the authorized organization.
Selling, redistributing, publishing, uploading, publicly sharing, or transferring the materials to third parties outside the authorized organization is not allowed.
12. Reasonable adaptations
The authorized organization may make reasonable adaptations to fit the cast, group size, staging needs, age range, language, or educational context.
These adaptations do not turn the musical into a new work and do not transfer copyright ownership over the original materials. Kaikana Musicals must continue to be credited as the owner or provider of the musical.
13. Intellectual property
All intellectual property rights in the musicals, texts, songs, scores, recordings, graphic materials, production resources, and Kaikana Musicals content belong to Kaikana Musicals or to their respective authors and licensors.
Purchasing a product does not transfer intellectual property ownership. It only grants a limited license of use according to the license option selected.
14. Use of artificial intelligence tools
Kaikana Musicals may use advanced digital tools, including generative artificial intelligence tools, as support in different creative, technical, editorial or production stages of its musicals and related materials.
Some textual, visual, audio, promotional or demonstration materials may have been created, assisted, edited, processed or enhanced using such tools, always within a process of selection, review, adaptation and editorial responsibility by Kaikana Musicals.
15. Use restrictions
The customer may not:
- resell, redistribute, or share the materials with third parties;
- publish downloadable files online or on public platforms;
- use the materials to create an unauthorized commercial derivative product;
- present the materials as their own;
- hold undeclared or unauthorized professional performances;
- monetize recordings without express authorization.
16. Payments
Payments are processed through secure external providers such as Stripe. Kaikana Musicals does not store full customer card details.
The purchase is considered completed once payment has been successfully confirmed.
17. Refund policy
Because Kaikana Musicals products are digital, refunds are not available once access to materials, licenses, or downloads has been granted.
Before completing a purchase, the customer must review the musical information, language, price, selected license, and order details.
If a genuine technical issue prevents access to purchased materials, Kaikana Musicals may review the case and offer a reasonable solution.
18. Accuracy of order information
The customer is responsible for providing accurate information about the organization, email, license type, start date, number of professional performances, and any other details required to issue or associate the license.
Kaikana Musicals may request additional information if data appears incomplete, contradictory, or incompatible with the selected license type.
19. Changes to products, prices, or terms
Kaikana Musicals may update products, prices, contents, licenses, or conditions at any time. The terms applicable to a purchase are those in effect when the order is placed.
